Please find attached in Annex A an extracted copy of the minutes recorded during the meeting of the Contingency Application Panel on 17 May 2013.  We have extracted the portions of the minutes relating to discussion of Mr Leech’s case, removing reference to third parties and junior members of staff in line with Section 40(2) of the FOIA.

Section 40(2) provides that personal data about third parties is exempt information if one of the conditions set out in section 40(3) is satisfied. Under the FOI Act disclosure of this information would breach the fair processing principle (Principle 1) of the Data Protection Act 1998 (DPA), where it would be unfair to those persons or is confidential. Staffing 2012/13

It was agreed that while Mr Leech had not been fully informed that “back-dating” did not also mean “back-accruing”, but it was not possible to adjust this, due to the accounting system we use. In any case, it did not leave Mr Leech in a worse position as his overspend was now discharged. He would have the full budget of £137,200 this year.
